Acceptable Use Policy (AUP)

Black & White Hosting, LLC Acceptable Use Policy (AUP) is issued to give our customers a clear understanding of what is expected of them while using Black & White Hosting, LLC service. A customer is considered anyone who accesses our services at any point whether for free or for pay. All customers must familiarize and comply with the following terms. The following terms are between you (the "client" or "customer") and Black & White Hosting, LLC.

Content

All services provided by Black & White Hosting, LLC must be used for lawful purposes only. The transmission, storage, or presentation of data, information or material deemed a violation of United States (Federal, City, and State) or International law is prohibited.

Adult Content

Adult content such as pornography, sex related material, and anything deemed a violation by Black & White Hosting, LLC is prohibited from our servers. This includes linking.

Examples of Content that is not Acceptable

Illegal software/warez sites
Hacking/cracking programs or archives
Illegal mpeg layer two or three files (MP3 or MP3) that constitute copyright infringement
Pornography
Spamming software
Any infringement of copyright, trademark, trade secret, patent, or other intellectual property
Content that exploits children under the age of 18
Hate propaganda (racist, threatening, slanderous, or otherwise abusive content)
The promotion or incitement of illegal activities
Banned Scripts - The following scripts are banned from use on any of our shared or reseller packages due to their effects on server load.
IRC egg drops
Proxy servers
IP spoofers
Port scanners
Anonymous mailers
Mail bombers
SPAM and Unsolicited Commercial Email (UCE)

Unsolicited commercial advertisements (also known as spam) are not allowed to be sent from or through Black & White Hosting, LLC servers. Black & White Hosting, LLC has a zero-tolerance stance and will prosecute violators to the fullest extent of the law. In addition, the uploading and/or use of scripts that’s purpose are for the use of spamming is forbidden. Customers in violation of this policy will have their account closed with no refund. Our servers have software that will identify all known scripts used in the sending of unsolicited email and will put a swift end to them. Furthermore, we will forward all violations to the proper authority.

Misuse of System Resources

Any attempt to knowingly undermine or cause harm to an Black & White Hosting, LLC customer or server is strictly prohibited. This includes, but is not limited to: using excessive CPU time (more than 20% for five (5) minutes or longer); the resale of disk space within your account; excessively backing up files unrelated to your website; or the resale of remote access to CGI scripts. We are quick to suspend any account that abuses the server’s resources due to the negative affect on a shared server.

SSH

Black & White Hosting, LLC allows no use of SSH, period. Any customer that attempts to use a script which can be used to enable SSH will be suspended without warning.

Support

Black & White Hosting, LLC expects customers to have a decent understanding and working knowledge of aspects of their website’s operation. Please, do not expect Black & White Hosting, LLC to teach you have to use the most basic aspects of the tools at your disposal.

Backup

It is the customer’s responsibility to maintain local backups of their account content and not Black & White Hosting, LLC. Each customer will have access to a “Backup Manager” in which they will be able to backup their files.

Reporting Violations of Black & White Hosting, LLC's AUP

If you wish to report a violation of this AUP, then please direct your information to our Abuse department at abuse@BlackAndWhiteHosting.com. If readily available, please provide the following information:

The IP address in the alleged violation
The date/time of the alleged violation
Any evidence of the alleged violation

Black & White Hosting, LLC reserves the right to edit its policies contained in this document at any time without notice. It is our customerÂ’s job to continue to refer to this document. At no point shall Black & White Hosting, LLC lack of enforcement of these terms constitute a waiver. If you do not agree to all terms then you are not permitted to use Black & White Hosting, LLC services.
