Terms of Service (TOS)

Black & White Hosting, LLC Terms of Service (TOS) is issued to give our customers a clear understanding of what is expected of them while using Black & White Hosting, LLC service. A customer is considered anyone who accesses our services at any point whether for free or for pay. All customers must familiarize and comply with the following terms. IMPORTANT NOTICE: All domain registration(s) are non-refundable.

The following terms are between you (the "client" or "customer") and Black & White Hosting, LLC.

Bandwidth Usage

All customers are allocated a specified amount of monthly bandwidth at the time of purchasing their account. Should a customer’s account reach the maximum allocated amount before the end of the month then their account will be automatically suspended until they contact us. An account will stay suspended until more bandwidth is purchased or the new billing cycle begins. Unused bandwidth from one month cannot be carried over to the next.

Uptime Guarantee

Our guarantee is that there are no guarantees. We work hard to maintain 100% uptime and we will do our best to stick to as close to 100% as possible. However, we cannot guarantee this do to the inherent nature of the Internet. Instead we average closer to a 99.9% uptime rate.

Refusal/Cancellation of Service

Black & White Hosting, LLC reserves the right to refuse or cancel service without warning to any account holder. All accounts terminated or suspended do to policy violations will not be refunded.

Payment of Fees

If you fail to renew your account on time then your account will be suspended. If no payment is received within fifteen (15) days of your renewal date then your account will be suspended. Once an account has been suspended there will be a twenty-five dollar ($25) re-activation fee, to be paid prior to the account being turned on. Black & White Hosting, LLC understands that under certain circumstances a person may fail to be able to pay within fifteen (15) days. If this is the case, please write us an email explaining your situation.

Prices

Black & White Hosting, LLC reserves the right to modify, by increasing or decreasing, their prices at any point in time at the end of billing cycles.

Indemnification

All customers agree to indemnify Black & White Hosting, LLC from any liability, claim, loss, damage or expense arising out of a customerÂ’s negligence in violating any term or conditions contained in this agreement or resulting from the use of Black & White Hosting, LLC services. This means that if Black & White Hosting, LLC is sued because of a customer, the customer will pay all damages, costs, and attorneyÂ’s fees.

Limitation of Liability

Black & White Hosting, LLC shall not be responsible for any damage incurred through Black & White Hosting, LLC's servers going offline or being unavailable. Furthermore, Black & White Hosting, LLC shall not be responsible for any damage incurred through corruption or deletion of any material from one of its servers.

Agreements with Minors

Black & White Hosting, LLC requires this agreement to be made with customers over the age of eighteen (18) years and are qualified to enter into a contract. Otherwise, a parent or guardian must assume responsibility over the agreement.

Refund Policy

You may cancel your account with us at any time, and you will therefore not be billed for the next month. However, we do not issue any form of refund due to an early cancellation.

Disclaimer

Black & White Hosting, LLC reserves the right to edit its policies contained in this document at any time without notice. It is our customerÂ’s job to continue to refer to this document. At no point shall Black & White Hosting, LLC lack of enforcement of these terms constitute a waiver. If you do not agree to all terms then you are not permitted to use Black & White Hosting, LLC services.
